Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Channels mobile application, website, and related services (collectively, the “Service”) operated by Channels LLC (“Channels,” “we,” “our,” or “us”).

By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

Eligibility

The Service is intended solely for individuals who are at least eighteen (18) years of age.

By using the Service, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable law

Channels reserves the right to request age verification and to suspend or terminate accounts that violate this requirement.

Account Registration and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate and complete information
• Update information as necessary
• Immediately notify us of unauthorized access

Channels may suspend or terminate accounts suspected of fraud, impersonation, misrepresentation, or unauthorized activity.

User Conduct and Prohibited Activities

You agree not to:

• Harass, threaten, intimidate, exploit, or defraud other users
• Engage in stalking, hate speech, discrimination, or sexual exploitation
• Upload unlawful, defamatory, obscene, or harmful content
• Solicit money, financial information, or personal data from other users
• Use the Service for commercial advertising or spam
• Circumvent safety mechanisms or moderation tools

Channels may remove content and terminate accounts at its sole discretion to protect users and platform integrity.

Live Video Sessions and Recording Prohibition

Channels facilitates real-time video interactions between users.

You expressly agree that you will not:

• Record, screenshot, stream, capture, store, or reproduce any live session
• Distribute or publish any portion of a live interaction
• Use third-party software or hardware to bypass recording protections

Unauthorized recording or distribution may result in immediate termination, legal action, and potential civil liability.

Channels may implement technical safeguards to prevent recording but does not guarantee absolute prevention.

User Content License

You retain ownership of content you upload. By submitting content, you grant Channels a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and process such content for operating, improving, and promoting the Service.

You represent that you have all necessary rights to grant this license.

Channels may remove content that violates these Terms.

Subscriptions, Billing, and Refunds

Premium features are offered through paid subscriptions processed via Apple’s in-app purchase system.

Subscriptions:

• Automatically renew unless canceled
• Must be canceled through Apple
• Are governed by Apple’s billing policies

Channels does not process or store payment card information.

Refund requests must be directed to Apple.

Account Deletion, Suspension, and Enforcement

Channels reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate accounts for violations of these Terms, suspected fraud, safety concerns, or conduct that compromises platform integrity.

Users may request account deletion in accordance with the procedures described at /account-deletion.

Upon verified deletion:

• Access credentials will be revoked
• Profile visibility will be removed
• Content may be deleted or anonymized

Deletion does not relieve users of obligations incurred prior to termination.

Channels may retain certain information where permitted or required by law, including for fraud prevention, dispute resolution, legal compliance, and safety enforcement.

Repeated attempts to evade termination may result in permanent bans, device restrictions, or legal action.

Safety Disclaimer

Channels does not conduct criminal background checks or guarantee the identity of users.

Interactions with other users are at your own risk.

Channels is not responsible for the conduct of users, whether online or offline.

Privacy and Data Rights

Your use of the Service is also governed by our Privacy Policy.

Users located in the European Union, United Kingdom, or California may have additional data rights under GDPR and CCPA/CPRA, including the right to access, delete, or correct personal information.

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied.

Channels disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

Channels does not guarantee compatibility outcomes, relationship success, or personal results.

Limitation of Liability

To the fullest extent permitted by law, Channels LLC and its affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Service.

In no event shall Channels’ total liability exceed the amount paid by you to Channels in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Channels LLC and its affiliates from any claims, liabilities, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of applicable laws
• Your infringement of third-party rights

Binding Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service, including account suspension, termination, or data retention, shall be resolved exclusively through binding arbitration.

Arbitration shall be conducted by the American Arbitration Association and shall take place in the State of New Jersey.

You agree that:

• Disputes will be resolved on an individual basis only
• You waive the right to participate in class actions or representative proceedings

Nothing in this section prevents either party from bringing claims in small claims court where permitted.

Governing Law

These Terms shall be governed by the laws of the State of New Jersey, without regard to conflict of law principles.

Modifications

Channels reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
